Good luck.”Carl Criminal is having a bad day, early this morning he realized that someone had stolen his car from his driveway. He had planned to use the car as part of his plan to rob the First National Bank. Given that he needed a car to make his escape from the planned robbery, Carl asked his friend Christine if she could give him a ride to the First National Bank. Carl told Christine that his car was in the shop and that he needed to go to the bank to take out a loan, Carl did not tell Christine anything about the planned robbery of the bank. Carl arranged with Christine to meet at Carl’s apartment and for Christine to bring Carl to the bank at about 4:30 p.m. just before the bank was scheduled to close for the day. Carl collected a ski mask, a note demanding money, and a gun. Christine arrived at the agreed upon time and drove Carl to the bank. Carl asked Christine to wait in the car and told her he would only be a few minutes. Shortly after Carl entered the bank Christine heard a gunshot and the bank’s alarm system began to sound, fearing for her safety Christine quickly drove away from the bank, leaving Carl inside the bank.Meanwhile, inside the bank, Carl had handed his note demanding money to the teller, told the teller to give him all the money and then Carl fired a warning shot to make sure the teller knew he was serious, the teller quickly complied and gave Carl all the money she had available. Carl exited the bank with the money and he saw that Christine was gone, thinking quickly he used his gun to force his way into a car that had just driven into the bank’s parking lot, he told the driver of the car, Vicky, to drive away from the bank or he would kill her. Carl had a friend (Dave) who ran a somewhat shady auto repair business nearby (really more of a chop-shop) and demanded that Vicky drive to his friend’s business and park in the back of the building where the car would not be visible from the street. They arrived at the repair shop and Carl took Vicky’s car keys and went inside. He told his friend, Dave, about the robbery and asked Dave to lend him a car. Dave agreed to help and gave Carl the key to a shop car that was parked outside and behind the building, Carl thanked Dave and told Dave that he would take care of him when things settled down. Carl took the key to the shop car and went back outside, he retrieved Vicky, who he had locked and restrained inside Vicky’s car, and made Vicky come with him in the new getaway car. Carl drove Vicky about ten miles away and made her get out of the car in a remote area, he told her not to tell anyone anything and he would arrange for her to get her car back and she would not be harmed. It was about 6:30 p.m. when Carl left Vicky on the remote dirt road, it was the middle of the winter and it was dark and cold. Carl then drove away leaving Vicky alone on a dirt road in a remote area.At the same time Christine had driven back to the bank to look for Carl. Police officers were at the bank conducting their investigation and as a result Christine was questioned by police at the scene of the robbery. Christine explained that she had driven her friend Carl to the bank and was concerned about him, the police quickly deduced that Carl was the robber. Within a matter of an hour Carl was under arrest for the armed robbery of First National Bank. As the police questioned Carl, they learned from the Highway Patrol that Vicky had been killed when she was hit by an automobile on that remote road outside of town. The car that struck Vicky was not speeding, the driver of the car was not violating any traffic laws and the driver was not impaired in any sense, the driver of the car simply was not able to see Vicky in time to stop on that dark lonely road—the police determined that the driver faced no criminal liability for the accident that resulted in Vicky’s death.
